Terms and Conditions:
Welcome to MD learning, a free online courses program exclusive for Puerto Rico Medical Defense (PRMD) insureds. Please read these terms and conditions carefully before using MD Learning online courses. Your access to and use of the service is conditioned on your acceptance and compliance with these terms. These terms apply to all users, visitors and others who access or use the service. By accessing or using the service you agree to be bound by these terms and conditions. If you disagree with any part of the terms or if you do not accept these terms, then you may not access the service of the free online courses. We may modify these terms and conditions, for any reason, at any time, by posting a new version on our website; these changes do not affect rights and obligations that arose prior to such changes. If you object to any provision of these terms and conditions or any subsequent modification or become dissatisfied with our website in any way, your only recourse is to immediately terminate use of MD learning.
Registration and Termination:
The online courses will be available through an external website that will link you to http//www.medicalinteractive.com, the website of Medical Interactive Community (MI). The user acknowledges that MI is a third party with an external website, which page, content and infrastructure of the page and online service is provided, operated and owned by them, not by PRMD. By accessing the link, you agree PRMD exchange personal information such as your name, last name, address, e-mail address and professional specialty or designation with MI. The information will be used to create a profile that will track the online courses you will take in the website. By registering on MD learning, you acknowledge, agree and consent to the above described information exchange with the third-party website. You agree that PRMD has no control over, and assumes no responsibility for the content, privacy policies or practices of any third-party web sites or services, including MI.
The MD Learning program is created for the unique use of PRMD insureds. All users registered as PRMD insureds will have free access to the online courses and to the full catalog of courses offered by MI website. By becoming a registered member and creating an account, you agree to be responsible for maintaining the confidentiality of your password or other account identifiers. You accept and agree that free access will be granted only while our medical malpractice insurance policy is active and in effect. You accept and agree that the cancellation or suspension of the policy is reason for the termination of free access to the online courses. You also consent, accept and agree that, in case of policy cancellation or termination, MI will keep your personal registration data as part of your customer profile in their website, but will no longer be classified as a PRMD insured user and no free access to the courses will be granted.
You agree and consent that the online courses service does not grant you any right with regards to your insurance coverage or policy, and is not intended to be considered as a right or endorsement to your policy. PRMD may terminate or suspend access to the online courses benefit, without prior notice or liability, for any reason, including but not limited to, your breach of the present terms, wrong use or abuse of the service or other reasons. You agree that PRMD may suspend or terminate the online courses service for temporary or indefinite periods of time, including cancelation of the service at any time, without notice to you.
Content, Use, Intellectual Property and Liability Disclaimer:
The content and infrastructure of the online courses is provided by MI and through the website owned and operated by MI and are not provided for your commercial use. No user is entitled of ownership or intellectual property rights to the courses. All users agree that all Intellectual Property Rights remain the property of MI. You agree that you will not alter, remove, copy or trademark any course in violation of the intellectual property owned by MI.
The online courses and other materials or services are provided “as available” for informational purposes only and are not intended as legal, insurance, medical, accounting, tax or professional advice or other advice. The online courses do not establish medical standards of care and are not a substitute for the correctness or reasonable discretion of skilled and informed clinician’s standards of care, which vary depending on the unique presentation of each patient. PRMD shall not be liable for consequential damages of any kind for the following: failure of user or insured to achieve, satisfy, maintain, meet or otherwise comply with professional or other accreditation, credentialing, certification, licensure, medical privilege or for failure to comply with standards of care or malpractice or other medical or professional liability claims.
Governing Law:
The governing law to resolve any controversy or dispute with regards to the use of the online courses against PRMD will be the governing law of the Commonwealth of Puerto Rico. You agree that any claim, dispute or controversy against PRMD, its affiliates or representatives, arising of or in connection with the online courses, directly or indirectly, shall be filed in the Court of San Juan, Puerto Rico, until its resolution. You hereby waive any right to participate in a class action or representative lawsuit or to file any suit in other court, including the federal court for the district of Puerto Rico. You also agree not to make any press release or other public statement about the existence of the dispute.
Courses’ Certification by local Board:
On line courses of 0.75 credits or more are certified by the Puerto Rico Medical Licensure Board (Junta de Licenciamiento y Disciplina Médica) to serve as continued medical education for physicians. The online courses are also certified by the American Council of Continued Medical Education (ACCME). You accept and agree that it is your unique and sole responsibility to notify and request credit validation to the applicable Board, to obtain the credits as continued medical or professional education upon completion of the courses. You herby waive and release PRMD of any responsibility as to this effect. You also consent and agree that to obtain the credit certification or validation, you must finish the online courses, including the pre-test and/or post-test or any other requirement. You waive and release PRMD of any responsibility as to this effect, including the noncompliance with the online courses completion requirements, which is your unique responsibility. You expressly agree that your use of, partial use of, or inability to use the online courses service is at your own sole risk.
Consent and Acceptance:
I certified that I am of legal age, and that I have read and accepted the User Agreement.
